What is Sexual Harassment?
Sexual harassment can take many forms. It may involve unwanted physical contact, unwanted flirting, inappropriate conduct or inappropriate communications. It is important to understand that verbal harassment is harassment. Unwanted and inappropriate jokes, e-mails and flirtation can form the basis of a sexual harassment lawsuit. Both federal law (Title VII) and Florida state law prohibit sexual harassment in the workplace.
Quid Pro Quo versus Hostile Work Environment
Quid pro quo harassment occurs when an employee has his or her employment status affected by a request for sexual favors, physical contact, a date or a romantic relationship.
Another form of sexual harassment relates to a hostile work environment. In order to prevail in a sexual harassment suit related to a hostile work environment, an employee must prove that they were forced to work in an intolerable work environment.
Under either theory of the case, a plaintiff may be able to recover regardless of whether they were fired or quit their job. Proving a claim after you have quit your job requires a demonstration of constructive discharge - a claim that you had no reasonable alternative but to quit because the working environment had become intolerable.
