We believe in ‘Getting to Yes’
Naturally, as counselors, we advise our clients what positions will maximize their protection, but we encourage our clients to consider proposing positions that are likely to be perceived as fair by the other party. Proposals perceived to be fair are more likely to be accepted without protracted negotiation, with less legal expense, while building trust, and avoiding antagonism.
The decision regarding how aggressive you want us to be is yours alone, provided it does not entail deception or unethical conduct.
| Employment Law 101. Our site keeps you up to date with answers to most employment law questions. Click here to get answers to most or your employment law questions. Please understand that many of the laws work in tandem, there are exceptions to many rules, and the laws don’t always apply to individual situations, so the general information we provide is no substitute for obtaining legal advice in your situation. |
Know before you sign.
When you are handed a document that says “Agreement” you are reading a contract, a document that is legally binding and enforceable. Signing a contract without obtaining legal advice could have far-reaching consequences you will later come to regret, whether it's before or during employment or part of a severance package.
An experienced employment lawyer can spot the minefields and negotiate reasonable modifications intended to benefit you without harming the other party. A layperson trying to negotiate an employment agreement is like a lawyer trying to overhaul an engine. It may be possible, but would you really want to take this car on a coast-to-coast trip?
